  • You have completed probation.
  • You have completed all sentence requirements, such as fines, classes, or community services.
  • You do not have any pending probation, parole, criminal charges, or indictments.

What Felonies Cannot be Expunged in California?

Certain felonies are not eligible for expungement, these include:

  • Lewd acts with a child
  • Statutory rape
  • Any sexual acts with a child

Felonies may be expunged if:

  • ​No time was served in prison
  • Felony probation was successfully completed
  • The applicant is not currently facing criminal charges, on probation, or serving another sentence

Will my Expunged Record Show up on a Background Check in California?

Your expunged or sealed record will not show up on a background check in California. The so-called "Ban the Box" law in the California Labor Code says an employer cannot ask about it. In addition, AB 1008 makes it unlawful for private employers with five or more employees in California to include on any employment application any question that seeks the disclosure of an applicant’s conviction history before the employer makes a conditional offer of employment to the applicant. AB 1008 also makes it unlawful to inquire into or consider the conviction history of the applicant until after the employer has made a conditional offer of employment to the applicant. The only way for your expunged records or sealed record to show up is when law enforcement agencies run a background check and not public employers.
